1. Detailed Description of Goods and/or Services

1.1 Richester Foods is a business in the confectionary industry that manufactures and sells sweets

2. Order Placement

2.1 By placing an order, the user represents and warrants that they are legally capable of entering into binding contracts and agrees to be bound by these terms.

2.2 Before proceeding to finalise any order the user will be given an opportunity to review and, if required, correct the contents of his order as well as any information or addresses provided. Upon finalising this process, notification thereof will be sent to Richester Foods and the user's order will only be deemed to be accepted once Richester Foods has processed such order and sent the user a confirmatory email.

2.3 The products and prices stated on the website are only valid while stocks last.

2.4Richester Foods will in no way be held liable to provide a product at an expired price or where the product concerned is no longer in stock or available.

2.5The products described or graphically represented on the Website may differ slightly in colour, shape, form, design, contents and appearance from the final product delivered.

2.6All items are subject to availability. Richester Foods endeavours to fulfil all orders as best and timeous as possible. Should a product be out of stock, Richester Foods will offer the user an alternative delivery date, alternative products or a full refund.

3.Delivery Policy

3.1Subject to availability and receipt of payment, requests will be processed within 3 days and delivery information confirmed by way email.

3.2Unless otherwise agreed or stipulated in the user's order or on the website, the user's order will be delivered by the courier company or persons, as may be specified by Richester Foods, to the address provided during the order process.

3.3Delivery will take place within 1 - 3 business days in major cities and 5 - 7 days in outlying areas.

3.4Although every effort will be made to ensure that delivery takes place within the time period specified in clause 3.3, the size and quantity of an order as well as the distance between Richester Foods and the delivery address provided, amongst other circumstances, may require a longer period for delivery. The user will be notified from time to time of any anticipated delays with delivery and, in such circumstances, the updated delivery time will substitute and take preference over the delivery time stipulated in the confirmatory email or reflected on the Richester Foods’ invoice.

3.5The initial shipping costs quoted to the user when an order is placed are only estimated costs. Richester Foods shall subsequently contact the user and provide the user with a quotation for the actual costs. Richester Foods will not ship an order unless the user has approved the actual costs. If the user does not approve the actual costs, the order will be cancelled and Richester Foods will refund the user the price paid for the goods concerned.

3.6The user acknowledges that Richester Foods shall rely on the accuracy of the delivery address as provided by the user. Richester Foods does not verify the accuracy of any particulars of a delivery address provided by the user. The user shall check the accuracy of the delivery address every time when placing an order. Richester Foods shall not be liable for any costs, loss, damages or claims incurred by the user relating to an inaccurate or incorrect delivery address provided by the user.

3.7Risk in respect of ordered products will pass to the user once they have been collected from Richester Foods’ premises by the relevant courier. Ownership in such ordered products will, however, remain reserved until the full purchase price and all outstanding sums (including VAT and any and all applicable delivery charges, costs, fees and the like) due by the user have been paid to and received by Richester Foods.

3.8If products are indicated as "pre-order" on the website, Richester Foods will only order such product for the User once it has received full payment from the User in respect of such product.

4. Export Restriction

4.1The offering on this website is available to South African clients only.

5. Return and Refunds Policy

5.1The provision of goods and services by Richester Foods is subject to availability. In cases of unavailability, Richester Foods will offer the user an alternative delivery date, alternative products or a full refund within 30 days.

5.2A 20% handling fee will be charged on any unused, undamaged and unopened items returned to Richester Foods. A 10% cancellation fee on any confirmed orders will be charged when an order is cancelled within 24 hours of placing order. No orders can be cancelled after 24 hours.

5.3To qualify for the refund, customer needs to notify Richester Foods within 7 days from shipment that they would like a refund. The product(s) must arrive at our physical address within 14 days of the original shipment and in the same condition we shipped it - unopened, unused, and undamaged in its original condition and any and all seals, packaging, labels, shrink-wrap and/or boxing remains intact. Please repack the products carefully for the return trip to avoid damage in transit. Products that have been opened, used, or damaged in transit will not be accepted for return and will be returned to the customer at the customer's expense. If you believe there will be a problem with the product reaching us within the 14-day period, contact our customer service department to make special arrangements. We're here to help and to work with you to find a solution. A handling fee will be charged as per paragraph 5.2.

5.4It is ultimately the customers' responsibility to research if the products they buy will meet their specific needs.

5.5Any product returned must be accompanied with the user's proof of payment in respect of such product. The product must be returned via courier (not via post office courier or service) to Richester Foods’ physical address. No returns will be accepted sent via Post Office as damage and/or losses can easily occur.

5.6If you are planning on returning an order, please call 012 666 8606 & email returns@richesterfoods.co.za to request a return authorisation number. Other email addresses are not setup to handle return requests. No unauthorised returns will be processed.

5.7If a product is returned, Richester Foods will examine the product and advise the customer accordingly if they are eligible for a refund based on paragraph 5.2.

5.8If a user has cancelled an order, and the user wishes to revive such order, the user needs to place a new order for the products concerned. Product availability cannot be guaranteed.

6. Customer Privacy Policy

6.1Richester Foods shall take all reasonable steps to protect the personal information of users. For the purpose of this clause, "personal information" shall be defined as detailed in the Promotion of Access to Information Act 2 of 2000 (PAIA). 7. Payment Options Accepted

7.1Payment may be made via Visa and MasterCard.

8. Card Acquiring and Security

8.1Card transactions will be acquired for Richester Foods via PayGate (Pty) Ltd who are the approved payment gateway for all South African Acquiring Banks. PayGate uses the strictest form of encryption, namely Secure Socket Layer 3 (SSL3) and no card details are stored on the website. Users may go to www.paygate.co.za to view their security certificate and security policy.

9. Customer Details Separate from Card Details

9.1Customer details will be stored by Richester Foods separately from card details which are entered by the client on PayGate’s secure site. For more detail on PayGate refer to www.paygate.co.za

10. Merchant Outlet Country and Transaction Currency

10.1The merchant outlet country, at the time of presenting payment options to the cardholder, is South Africa. Transaction currency is South African Rand (ZAR).


11.1Richester Foods takes responsibility for all aspects relating to the transaction including sale of goods and services sold on this website, customer service and support, dispute resolution and delivery of goods subject to any other terms mentioned.

12.Country of Domicile

12.1This website is governed by the laws of South Africa and Richester Foods chooses as its domicilium citandi et executandi for all purposes under this agreement, whether in respect of court process, notice, or other documents or communication of whatsoever nature, 9 Hennopsrivier Street, Sunderland Ridge, Centurion, Gauteng, 0157.


13.1Richester Foods may, in its sole discretion, change this agreement or any part thereof at any time without notice.
